1. Agreement to Terms

By accessing or using Elenta ("Service"), operated by Elenta LLC, you agree to be bound by these Terms of Service. These terms apply to all users of the service.

2. Description of Service

Elenta is a process automation platform for digital marketing agencies and freelancers. The Service provides:

  • Prospecting: Business discovery by location and category using publicly available data
  • Bulk Analysis: Website analysis of multiple URLs uploaded via CSV or Excel
  • Web Audit: Individual website analysis for speed, SEO, accessibility, performance, and other metrics
  • Data Outputs: Contact information, social media profiles, website scores, and PDF reports

The Service uses third-party data providers and AI to deliver results. We do not guarantee the accuracy, completeness, or timeliness of any data provided.

3. Account Registration and Eligibility

You must create an account to use the Service. You agree to provide accurate, current, and complete information and to update it as needed. The Service is intended for business use by agencies and freelancers.

4. Credits and Billing

The Service operates on a credit-based system. Credits are consumed when you run prospecting searches, bulk analyses, or web audits. Credits are reset to your plan maximum each month and do not roll over. Subscription plans are billed monthly or annually. You may upgrade or downgrade your plan at any time; changes take effect immediately at the start of the next billing cycle. All fees are in the currency specified at checkout and are non-refundable except as required by law.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with applicable laws, including data protection and privacy regulations. You must not:

  • Use the Service for spam or harassment
  • Scrape, reverse-engineer, or attempt to extract data beyond the intended use
  • Resell or redistribute data obtained through the Service without appropriate consent
  • Violate the terms of any third-party services we integrate
  • Use the Service to collect personal data in violation of privacy laws
  • Share your account credentials or allow unauthorized access

You are responsible for ensuring your use of contact data complies with applicable laws, including obtaining consent where required for marketing communications.

6. Data Accuracy and Limitations

Data provided by the Service is sourced from third parties and public sources. We do not warrant that any data is accurate, complete, current, or suitable for your purposes. Website scores and AI-generated summaries are provided for informational purposes only. You should verify critical information before relying on it for business decisions.

7. Intellectual Property

Elenta and its licensors own all rights in the Service, including the platform, software, design, and branding. By using the Service, you grant us a license to process your data to provide the Service. Reports and exports you generate are for your use; you may use them in client work subject to your compliance with these terms.

8. Third-Party Services

The Service integrates with third-party providers. Your use of the Service is subject to those providers' terms and policies. We are not responsible for third-party services, their availability, or the accuracy of data they provide.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELENTA LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Elenta LLC and its affiliates from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these terms, or your violation of any third-party rights or applicable law.

12. Termination

You may cancel your account at any time. We may suspend or terminate your access for breach of these terms, non-payment, or at our discretion. Upon termination, your right to use the Service ceases immediately. Data retention after cancellation is governed by our Privacy Policy.

13. Modifications

We may modify these terms at any time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance. If you do not agree, you must stop using the Service.

14. Governing Law

These terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of the United States.
